Terms of engagement

The Wills Clinic is part of Your Legal GP Limited and is owned by LYVE Group Limited.

1. About us

Your Legal GP Limited (“we”, “us”, “our”) is a company registered in England and Wales under company number 12919319.

We provide will-writing, estate planning, lasting power of attorney and related support services.

We are not a firm of solicitors and are not regulated by the Solicitors Regulation Authority (SRA). Where regulated legal advice or services are required, we may recommend that you obtain advice from an appropriately regulated professional.

2. Scope of services

The services we provide to you will be set out in your Engagement Letter, Quotation or Order Confirmation.

Our engagement is limited to the services specifically agreed with you.

Any additional work requested outside the agreed scope may incur additional charges.

3. Client responsibilities

You agree to:

  • provide complete and accurate information;
  • notify us promptly of any changes to information provided;
  • review any documents supplied to you carefully;
  • provide instructions within reasonable timescales; and
  • supply any identification documents reasonably requested.

We shall not be responsible for delays or errors resulting from incomplete, inaccurate or misleading information supplied by you.

4. Fees and payment

Our fees will be set out in your Engagement Letter, Quotation or Order Confirmation.

Unless otherwise agreed:

  • payment is due within 7 days of invoice;
  • work may not commence until any required payment has been received;
  • additional services requested outside the agreed scope will be charged separately;
  • any third-party costs incurred on your behalf will be payable by you.

Where payment remains outstanding, we reserve the right to suspend work until payment is received.

5. Cancellation and termination

You may terminate your instructions to us at any time by providing written notice.

If work has commenced before cancellation, you remain responsible for payment for work completed and any expenses incurred up to the date of termination.

We may terminate our engagement where:

  • you fail to provide instructions;
  • you fail to make payment when due;
  • a conflict of interest arises;
  • continuing the engagement would be unlawful or inappropriate; or
  • there is a breakdown in our working relationship.

6. Confidentiality

We will treat information provided by you as confidential and will not disclose it to third parties unless:

  • you authorise us to do so;
  • disclosure is necessary to provide the services requested by you;
  • disclosure is required by law; or
  • disclosure is necessary to protect our legal rights.

7. Identity verification and anti-money laundering

We may be required to undertake identity verification checks and request documentation to confirm your identity and address.

Where electronic verification or third-party verification services are used, an administration fee may apply.

Failure to provide satisfactory identification may prevent us from acting for you.

8. Data protection

We process personal information in accordance with applicable UK data protection
legislation.

Information provided by you will be used for:

  • providing services to you;
  • communicating with you;
  • processing payments;
  • complying with legal obligations; and
  • managing our business operations.

9. Reliance on advice and documents

Any advice, information or documents provided by us are supplied solely for your use and benefit.

No third party may rely upon our advice, recommendations or documents without our prior written consent.

10. Limitation of liability

Nothing in these Terms shall limit or exclude liability where it would be unlawful to do so,  including liability for:

  • death or personal injury caused by negligence;
  • fraud; or
  • any other liability that cannot be excluded by law.

Subject to the above, our total liability arising from any engagement shall not exceed the amount of our professional indemnity insurance cover at the time the claim arises.

We shall not be liable for any indirect, consequential or business losses.

12. Marketing communications

We may occasionally contact you regarding services that may be of interest to you.

13. Governing law

These Terms of Engagement are governed by the laws of England and Wales.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Acceptance

By instructing Your Legal GP Limited to provide services, you confirm that you have read and accepted these Terms of Engagement.
